These terms govern your use of the Clockcost apps and website ("Clockcost" or the "Service"), operated by Southern Housing LLC, 13541 Church St, Williston, SC 29853 ("we," "us"). By using the Service you agree to these terms and to our Privacy Policy. If you are using Clockcost because your employer or contracting company ("Account Holder") gave you access, these terms apply to you as a worker, and the Account Holder's agreement with us applies to the company.
Clockcost is a tool for recording time, location at clock-in and clock-out, materials, receipts, work orders, notes, and job costs for field crews. It produces records; it does not make employment, pay, or classification decisions. Your pay, your worker classification, and the terms of your work are set by the Account Holder, not by Clockcost.
Your worker profile and PIN are issued by the Account Holder. Keep your PIN private and do not share it or use anyone else's. You are responsible for records made under your PIN. Tell your Account Holder immediately if you believe your PIN has been used by someone else.
You agree to clock in and out truthfully, at the times and places you actually work, and to enter materials, receipts, and mileage accurately. Recording time you did not work, punching for another person, spoofing your location, or altering receipts is a violation of these terms and may be a violation of law. Time records are auditable: every edit is logged with who made it and when.
Clock-in and clock-out capture your device's location, and while you are clocked in at a job site with the app open, the app periodically checks whether you are still there. This is a core function of the Service. You may disable location permission on your device, in which case punches will be recorded without a verified location and the Account Holder may not accept them.
You may use Clockcost only for legitimate work recording for the Account Holder that gave you access. You may not: attempt to access another company's data or another worker's private records; interfere with or overload the Service; reverse engineer the app; upload unlawful, abusive, or infringing content in notes or photos; or use the Service to harass anyone.
Photos, notes, and other content you add belong to you and the Account Holder. You give us a license to store, display, and process that content solely to provide the Service. You are responsible for having the right to upload what you upload.
We work to keep the Service available and may release updates at any time. Some updates are mandatory for security; the app will tell you when a version can no longer be used. We may add, change, or remove features. The app is designed to work offline for clock-in and sync when connectivity returns, but we do not guarantee that every record made offline will sync if the device is lost, reset, or the app is deleted before syncing.
The app is free to download. Account Holders pay for the Service under a separate subscription agreement. Workers are never charged.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. GPS and network conditions can affect accuracy and timing; the Service is a recording tool and the Account Holder remains responsible for reviewing and approving records.
To the fullest extent permitted by law, Southern Housing LLC is not liable for indirect, incidental, special, or consequential damages, or for lost wages, lost profits, or lost data, arising from use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount the Account Holder paid us for the Service in the twelve months before the claim, or one hundred dollars ($100), whichever is greater. Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.
The Account Holder may deactivate your profile at any time. We may suspend or end access for violations of these terms. Records already made remain with the Account Holder as business records, subject to our Privacy Policy.
These terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in South Carolina, and you consent to their jurisdiction.
We may update these terms. We will post the new version here with a new date and, for material changes, notify Account Holders in the app or by email. Continued use after the effective date is acceptance of the updated terms.
